Congress is tightening China biotech rules, but a total deal ban is unlikely

Probably not an outright stop—but Congress is moving toward tighter controls on China-linked biotech deals.

The BIOSECURE Act is already law as part of the FY2026 National Defense Authorization Act. It restricts federal agencies, contractors, grants, and loans from using biotechnology equipment or services supplied by designated “biotechnology companies of concern.”

A House committee recently advanced an updated BIOSECURE proposal that reportedly covers WuXi AppTec, WuXi Biologics, BGI Group, and MGI/Complete Genomics, with a proposed transition deadline of January 31, 2032.

A separate bipartisan Biotechnology Investment National Security Act would expand outbound-investment screening to Chinese biotech. It could cover equity investments, joint ventures, clinical research, manufacturing, licensing, and pharmaceutical development—but it is not yet law.

The likely effect is selective decoupling:
deals involving federal money, sensitive genetic or multiomic data, strategic technologies, or designated Chinese firms face the greatest risk. Private-sector licensing deals are less likely to be banned outright unless Congress passes broader investment restrictions.

The political momentum is real. House China Committee Chairman John Moolenaar is pressing companies over China-based clinical trials and supporting additional guardrails, while lawmakers are balancing national-security concerns against U.S. drug-development costs and access to Chinese innovation.

Bottom line:
Congress is unlikely to stop every China biotech deal in the near term, but it may make many deals subject to review, disclosure, supply-chain restrictions, or eventual divestment. The biggest uncertainty is whether the Senate advances the broader investment-screening bill.
