Ascendis to Pay BioMarin Royalties in Global Yuviwel Patent Settlement

Ascendis Pharma and BioMarin reached a binding term sheet for a global patent settlement covering Yuviwel (navepegritide), Ascendis’ treatment for achondroplasia.

Ascendis will pay BioMarin royalties equal to 20% of net sales in the United States and 18% in the European Union, Brazil and South Korea.

Payments will apply from the first commercial sale in each territory—retroactively where applicable—through May 20, 2030.

In return, BioMarin will grant Ascendis a nonexclusive, worldwide license covering Yuviwel and related products for current and potential indications, including hypochondroplasia and combination use.

The agreement is intended to end patent disputes in the U.S., including an International Trade Commission case, as well as proceedings in Brazil, Denmark, Germany and South Korea.

The deal reduces Ascendis’ legal uncertainty and protects Yuviwel’s commercialization, but the royalties will substantially reduce the drug’s sales economics through 2030. The term sheet remains binding even if a definitive agreement is not completed by September 24, 2026.
